LOS ANGELES – A Los Angeles County resident alleges his claims for short and long-term disability benefits were denied without a full and fair review.
Michael Alves filed a complaint on Dec. 9 in the U.S. District Court for the Central District of California against The Hewlett Packard Enterprise Comprehensive Welfare Benefits Plan, Hewlett Packard Packard Enterprise Co. and Does 1 through 10 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that he became disabled in January and applied for disability benefits but was denied in June. The plaintiff holds The Hewlett Packard Enterprise Comprehensive Welfare Benefits Plan, Hewlett Packard Packard Enterprise Co. and Does 1 through 10 responsible because the defendants allegedly upheld their decision to deny plaintiff's disability benefits despite several appeals and failed to provide a full and fair review of his claims.
The plaintiff seeks benefits due to him, all legal fees and any other relief as the court deems just. He is represented by Charles J. Fleishman and Paul A. Fleishman of The Fleishman Law Firm in Woodland Hills.
