LOS ANGELES – A Hawthorne consumer claims an Inglewood car dealership falsely advertised a car's quality.
Joria S. Westry filed a complaint on Dec. 9 in the U.S. District Court for the Central District of California against the CarMax Auto Superstores California LLC and Does 1 through 75 alleging violation of the Consumers Legal Remedies Act and other counts.
According to the complaint, the plaintiff alleges that in 2015, she purchased a used car from the defendant that was represented to her as having undergone an inspection and was safe and reliable. The plaintiff holds CarMax Auto Superstores California LLC and Does 1 through 75 responsible because the defendants allegedly sold her a car with defects and claims the inspection was done by people with little experience or knowledge.
The plaintiff requests a trial by jury and seeks general damages, restitution and rescission of the purchase contract, incidental and consequential damages, punitive and statutory damages, all legal fees and interest plus any other relief as the court deems just.
