GreenBroz accuses Trimbros of copying patented trimmer design

SAN DIEGO – A San Diego company alleges an Oregon company unlawfully copied its patented design for an agricultural trimmer.

GreenBroz Inc. filed a complaint on Dec. 2 in the U.S. District Court for the Southern District of California against Laeger Built LLC, doing business as Trimbros.com, Jeffrey Laeger and Does 1-10 citing patent infringement and other counts.

According to the complaint, the plaintiff alleges that on Aug. 8, 2014, it was awarded the entire rights, title and interest of US Patent '263, a design patent for a blade assembly of an apparatus for trimming agricultural products. While the patent is still in full force and effect, the plaintiff alleges the defendants were found to have manufactured, imported, used, and/or sold an agricultural product trimmer that employs substantially the same ornamental look and appearance of plaintiff’s blade assembly, similar name and identical blade housing. As a result, plaintiff alleges it has suffered great and irreparable injury to its reputation and goodwill.

The plaintiff holds Laeger Built LLC, Laeger and Does 1 -10 responsible because the defendants allegedly could cause confusion among consumers by offering similar services and using the same marks as plaintiff's distinctive marks to capitalize and receive the benefit of plaintiff's reputation and goodwill.

The plaintiff requests a trial by jury and seeks judgment against defendants, preliminary and permanent injunction, account for all gains, profits, and advantages, trebling of damages, attorneys’ fees and costs incurred, interest, and further relief as the court may deem just.
