SAN DIEGO – A Solana Beach financing company alleges it is owed for a tuition loan program.
American Student Financial Group Inc. filed a complaint on Dec. 5 in the U.S. District Court for the Southern District of California against Lawrence D. Earle alleging breach of personal guaranty.
According to the complaint, the plaintiff alleges that it develops and implements tuition financing programs. The suit states the defendant owns Edudyne Systems Inc. and its subsidiary Dickinson of San Antonio Inc., which operates schools in Texas.
The suit states in 2013, the plaintiff entered into a Tuition Loan Program Agreement (TLPA) with Dickinson of San Antonio Inc. and Edudyne Systems with the defendant as the personal guarantor. The plaintiff holds Earle responsible because the defendant allegedly failed to promptly and fully satisfy, perform and pay all of its obligations arising under the TLPA.
The plaintiff requests a trial by jury and seeks judgment against defendant, damages, costs and expenses of suit, attorneys' fee, interest and other relief as deemed proper. It is represented by Alan Vanderhoff and Jeanne C. Vanderhoff of Vanderhoff Law Group in San Diego
