Design Collection Inc. claims several retailers unlawfully used textile design

LOS ANGELES – Several retailers are alleged to have sold garments with an unauthorized fabric design.

Design Collection Inc. filed a complaint on Dec. 13 in the U.S. District Court for the Central District of California against Zulily Inc.; Li Yuan Textile and Apparel Inc., doing business as Reborn Collection; Bonanza.com Inc.; Sears, Roebuck & Co.; Overstock.com Inc.; Palmers USA Inc.; White Mark Universal Inc.; The American Sarong Co.; Rumor Boutique; Stein Mart Inc.; and Does 1-10 citing copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from unauthorized use of its design DC-6599. The plaintiff holds the defendants responsible because the defendants allegedly used online and retail stores to distribute dresses and shirts that contain plaintiff's design.

The plaintiff requests a trial by jury and seeks to enjoin the defendants, award all profits to the plaintiff, statutory damages, all legal fees and interest plus any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs and David Shein of Doniger/Burroughs in Venice.
