LOS ANGELES – A textile company claims five of its copyrighted design were used on clothing without authorization.
Rex Fabrics filed a complaint on Dec. 13 in the U.S. District Court for the Central District of California against Spandex House Inc. and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business because its Fire Tornado, Graffiti, Jungle Fever, Love Mee and New Wage designs were used without authorization. The plaintiff holds Spandex House Inc. and Does 1 through 10 responsible because the defendants allegedly sold garments using fabrics that bear plaintiff's designs.
The plaintiff requests a trial by jury and seeks to enjoin the defendants from further infringing plaintiff's designs, all profits, statutory damages, all legal fees and interest plus any other relief as the court deems just.
