LOS ANGELES – A construction industry contractor allegedly owes nearly $150,000 to labor unions for employee contributions.
Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trusts filed a complaint on Dec. 16 in the U.S. District Court for the Central District of California, Western Division against Wooten Construction Co., Kenneth Wooten, Ray Wooten and Does 1 through 10 citing the Labor Management Relations Act and the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that they suffered damages from unpaid and late paid benefits from the defendants. The plaintiffs holds Wooten Construction Co., Kenneth Wooten, Ray Wooten and Does 1 through 10 responsible because the defendants allegedly breached their agreement with the plaintiff by failing to pay their monthly contribution on behalf of their employees and failed to submit reports.
The plaintiffs seek unpaid contributions of $147,500.59, plus interest and liquidated damages, statutory damages, $8,087.23 that was allegedly withheld from the vacation plan, all legal fees and any other relief as this court deems just.
