Consumer alleges Ford vehicle purchased from Enterprise Car Sales is defective

LOS ANGELES – A Huntington Beach man claims he was sold a car with a defective transmission.

Evan Basakis filed a complaint on Dec. 12 in the U.S. District Court for the Central District of California against the Ford Motor Co., Enterprise Rent A Car Co., doing business as Enterprise Car Sales, and Does 1-30 alleging violation of the Song-Beverley Consumer Warranty Act and other counts.

According to the complaint, the plaintiff alleges that he suffered damages from purchasing a 2013 Ford Focus that was equipped with a faulty Dual Power Shift six-speed transmission from Enterprise in 2014. The plaintiff holds Ford Motor Co., Enterprise Rent A Car Co. and Does 1-30 responsible because the defendants allegedly failed to inform the plaintiff the defective nature of the DPS6 transmission and that numerous repairs have failed to bring the vehicle in conformity with the warranty.

The plaintiff requests a trial by jury and seeks general damages, incidental and consequential damages, restitution and rescission, punitive and statutory damages, interest, all legal fees and any other relief as the court deems just. He is represented by Hallen D. Rosner and Jeffrey L. Le Pere of Rosner, Barry & Babbitt LLP in San Diego.
