Cavalry Portfolio Services alleged to have violated debt collection laws

SAN DIEGO – A San Diego woman alleges a debt collector used a deceptive representation in a collection letter.

Rosa E. Heredia filed a complaint on Dec. 9 in the U.S. District Court for the Southern District of California against Cavalry Portfolio Services LLC alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges she incurred financial obligations but fell behind in the payments owed on the alleged debt, which was assigned to the defendant for collection. The suit states the defendant sent plaintiff a letter seeking to collect the debt, which included a privacy notice informing plaintiff that it could disclose her non-public personal information to a third party.

The plaintiff holds Cavalry Portfolio Services LLC responsible because the defendant allegedly threatened invasion to debtor's privacy by disclosing personal information to third parties.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages of $1,000, costs of litigation and attorney’s fees. She is represented by Jessica R.K. Dorman and Robert L. Hyde of Hyde & Swigart in San Diego.
