Foot Traffic USA owner files suit over name of San Rafael shoe store

SAN FRANCISCO – A Kansas City individual and company claims a San Rafael business is using their mark to sell shoes and related items.

Charles T. Barnard and Foot Traffic USA LLC filed a complaint on Dec. 20 in the U.S. District Court for the Northern District of California against Foot Traffic Shoes alleging trademark infringement.

According to the complaint, the plaintiffs allege that they own the Foot Traffic mark. The plaintiffs holds Foot Traffic Shoes responsible because the defendant allegedly used the plaintiffs' Foot Traffic mark in its retail stores to advertise its business, which the plaintiffs allege can causes confusion among consumers.

The plaintiffs request a trial by jury and seek enjoin the defendant from further infringing plaintiffs' trademark, order the defendant to offer up for destruction all infringing products, monetary relief, all legal fees and any other relief as the court deems just. They are represented by Erick C. Howard of Shartsis Friese LLP in San Francisco and Joan K. Archer, Ph.D. of Husch Blackwell LLP in Kansas City, Missouri.
