LOS ANGLES – The marketer of the Snuggie blanket claims a Vernon custom embroidery business is selling a competing sleeved blanket product under a similar name.
Allstar Marketing Group LLC filed a complaint on Dec. 20 in the U.S. District Court for the Central District of California, Western Division against Allstar Marketing & Promotions Inc., doing business as Allstar Logo Inc., and Does 1-10 alleging trademark infringement.
According to the complaint, the plaintiff alleges that it has used the Snuggie mark since 2008. The plaintiff holds Allstar Marketing & Promotions Inc. and Does 1-10 responsible because the defendants allegedly used the Snuggie mark on their blankets, which the plaintiff alleges causes confusion among consumers.
The plaintiff requests a trial by jury and seeks permanent injunction against the defendant, profits and damages, compensatory damages, restitution, exemplary or punitive damages, all legal fees and any other relief as the court deems just.
