Dodge Avenger owner claims seat belt, air bags failed in accident

LOS ANGELES – A Virginia woman alleges she was injured in a crash because the seat belts and air bags in her Dodge vehicle failed.

Stacey Allen filed a complaint on Dec. 23 in the U.S. District Court for the Central District of California, Western Division against FCA US LLC and Does 1 to 25 alleging product liability and negligence.

According to the complaint, the plaintiff alleges that in October 2016, she fractured her eye socket, bruised her lung and sustained other physical injuries when the airbag of her 2010 Dodge Avenger sedan failed to deploy and her seat belt failed to secure her into place during an accident. The suit states after the accident, she discovered there was a recall on her vehicle that she had not received regarding the air bag and seat belt. The plaintiff holds FCA US LLC and Does 1 to 25 responsible because the defendants allegedly placed the vehicle into the market knowing the seat belt pretensioners and air bags did not work properly.

The plaintiff requests a trial by jury and seeks compensatory damages, interest, treble damages, all legal fees and any other relief as this court deems just. She is represented by Jonathan A. Michaels, Kathryn J. Harvey and Kristen R. Rodriguez of MLG Automotive Law, APLC in Newport Beach.
