LOS ANGELES – Life Alert Emergency Response claims that direct competitors that also manufacture emergency medical response services are using its marks for their advertising.
Life Alert Emergency Response Inc. filed a complaint on Dec. 23 in the U.S. District Court for the Central District of California against Responselink LLC, Alertone Services LLC and Does 1-10 alleging trademark infringement.
According to the complaint, the plaintiff alleges that in 2015, it entered into a settlement agreement with the defendants regarding trademark infringement. It alleges that the defendants continue to use its marks in internet advertising. The plaintiff holds Responselink LLC, Alertone Services LLC and Does 1 - 10 responsible because the defendants allegedly breached their settlement agreement with the plaintiff by using confusingly similar marks on their advertisements.
The plaintiff requests a trial by jury and seeks permanently enjoin the defendants from further infringing plaintiff's marks, order the defendants to deliver all materials bearing plaintiff's marks, pay all damages and profits to the plaintiff, trebled damages, statutory damages, all legal fees plus interest and any other relief as this court deems just.
