LOS ANGELES – A Florida table and linen rental company is accusing a Montclair party and event business of using its mark.
Over the Top Inc. filed a complaint on Dec. 19 in the U.S. District Court for the Central District of California against Over the Top Specialty Rentals Inc. alleging that the trademark infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Over the Top Specialty Rentals Inc. responsible because the defendant allegedly used the plaintiff's mark Over the Top mark in connection to similar services as plaintiffs.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's trademark, destruction of all infringing materials, actual damages, statutory damages of $100,000 per infringing domain name used, profits, exemplary damages, all legal fees and any other relief as the court deems just. It is represented by Lawrence S. Gordon, James A. Gale, Ashley G. Kessler and Jonathan E. Gale of Cozen O'Connor in San Francisco.
