Sky Billiards Inc. claims company is using its Best Choice mark to sell goods on Amazon

RIVERSIDE – An Ontario corporation claims a Florida company is using its trademark to sell items on Amazon.

Sky Billiards Inc. filed a complaint on Dec. 21 in the U.S. District Court for the Central District of California against the Gotshoed.com Inc. and Does 1 through 10 citing trademark infringement and other counts.

According to the complaint, the plaintiff has registered the trademark Best Choice Products and does business on Amazon. It alleges that it suffered damages to its business and reputation as the result of lower-quality products that bear its mark being sold on Amazon under the Best Choice mark. The plaintiff holds Gotshoed.com Inc. and Does 1 through 10 responsible because the defendants allegedly use the Best Choice mark without authorization.

The plaintiff requests a trial by jury and seeks permanent injunction against the defendant from further infringing plaintiff's trademarks, all profits, $250,000 for damages, statutory damages of $2 million per counterfeit mark, treble damages, all legal fees and any other relief as the court deems just.
