Amcor Industries alleges Ohio corporations Gorilla Graphics infringes trademark

LOS ANGELES – A Los Angeles automotive, motorcycle and all-terrain vehicle parts manufacturer claims an Ohio company is using its mark to sell vehicle wraps.

Amcor Industries Inc., also known as Gorilla Automotive Products, filed a complaint on Jan. 26 in the U.S. District Court for the Central District of California against Scherba Industries Inc. and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that it has used its Gorilla mark since 1983. The plaintiff holds Scherba Industries Inc. and Does 1-10 responsible because the defendants allegedly market and sell vehicle wraps under the Gorilla Graphics mark, which the plaintiff alleges is too similar to its own mark.

The plaintiff seeks to enjoin the defendants from further infringing plaintiff's trademark, damages, compensatory damages, all gains and profits plus interest, increase damages, punitive damages, all legal fees and any other relief as this court deems just.
