LOS ANGELES – A former employee of Move Inc. claims his application for disability benefits was unlawfully denied.
Noa Gibson filed a complaint on Dec. 28 in the U.S. District Court for the Central District of California against Aetna Life Insurance Co. and Move Inc. Welfare Benefit Plan citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2016, he became disabled and applied for disability benefits but was denied on Aug. 24, 2016. The plaintiff holds Aetna Life Insurance Co. and Move Inc. Welfare Benefit Plan responsible because Aetna allegedly upheld its decision to deny plaintiff's disability benefits despite him being entitled to those benefits under the plan's terms.
The plaintiff seeks remand of plaintiff's claim, payment of disability benefits to the plaintiff, immediate reinstatement to the plan, all legal fees plus interest and any other relief as the court deems just.
