Woman seeks payment of disability benefits from Life Insurance Co. of North America

LOS ANGELES – A Gardena resident formerly employed as a billing representative alleges her claim for disability benefits was wrongfully denied.

Dalad Lertnitiwong filed a complaint on Dec. 29 in the U.S. District Court for the Central District of California, Western Division against Life Insurance Co. of North America and Does 1 to 10 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2013, she became disabled from suffering overwhelming pain in her neck and back caused by spinal stenosis and was initially paid disability benefits until the benefits were terminated. The plaintiff holds Life Insurance Co. of North America and Does 1 to 10 responsible because the defendants allegedly denied plaintiff's claim for ongoing disability benefits despite having sufficient proof to support her claim.

The plaintiff seeks all plan benefits due and owing to the plaintiff, all legal fees plus interest at the rate of 10 percent per annum and any other relief as the court deems just. She is represented by Robert J. McKennon and Scott E. Calvert of McKennon Law Group PC in Newport Beach.
