Royal Printex Inc. alleges fabric design was unlawfully used by retailers

LOS ANGELES – Several retailers are alleged to have copied a Vernon company's textile design without authorization.

Royal Printex Inc. filed a complaint on Dec. 29 in the U.S. District Court for the Central District of California against NMW Import Inc., doing business as New Kathy; Ross Stores Inc., doing business as DD's Discounts; D'Rachel's Boutique Inc.; 2ne1 Apparel Inc., doing business as Fashiongo.net; and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of its copyrighted design RE1088 being used on other products. The plaintiff holds NMW Import Inc., doing business as New Kathy; Ross Stores Inc., doing business as DD's Discounts; D'Rachel's Boutique Inc.; 2ne1 Apparel Inc., doing business as Fashiongo.net; and Does 1 through 10 responsible because the defendants allegedly manufactured and sold fabrics to the public that bear plaintiff's designs and used them in garments.

The plaintiff requests a trial by jury and seeks enjoin the defendants from further infringing plaintiff's designs, all monetary damages, statutory damages, all legal fees, profits and damages, interest and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
