Cree Inc. claims counterfeit products are available on eBay, Amazon

SANTA ANA – A North Carolina corporation alleges counterfeit versions of its flashlights and other lighting products are being sold online.

Cree Inc. filed a complaint on Dec. 29 in the U.S. District Court for the Central District of California, Southern Division against LEDwise Technology Inc., doing business as RClite; LEDwise Inc.; Shuiwen Li; Kevin Lee; Eleta Technology Inc., doing business as Fei Ye; Li Sun; Modocholic Autowerks Inc.; Edmond Wailam Leung; and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds the defendants responsible because the defendants allegedly used online stores such as Amazon.com, eBay.com and their websites to sell products that are counterfeit copies of plaintiff's lighting products.

The plaintiff requests a trial by jury and seeks profits and damages, $2 million per counterfeit mark per type of goods, statutory damages, restitution, injunctive relief, all legal fees and any other relief as the court deems just. It is represented by Christopher D. Johnson, Christopher Q. Pham, Marcus F. Chaney and Hung Q. Pham of Johnson & Pham LLP in Woodland Hills.
