Tesla Model X owner files class action alleging the vehicle accelerates without warning

LOS ANGELES – The owner of a Tesla Model X alleges the car accelerated without warning, causing the vehicle to crash through a wall of his home and injure him and his son.

Ji Chang Son and K.M.S., a minor by and through his guardian ad Litem Yun Soo Oh, filed a complaint on behalf of all others similarly situated on Dec. 30 in the U.S. District Court for the Central District of California against Tesla Motors Inc. alleging violation of the California Consumer Legal Remedies Act and other counts.

According to the complaint, the plaintiffs allege that Ji Chang Son was pulling into his garage with his son as a passenger on Sept. 10, 2016. He alleges the vehicle suddenly accelerated and crashed through an interior wall in the garage, causing injuries to Son and his son.

The plaintiffs hold Tesla Motors, Inc. responsible because the defendant allegedly failed to properly inspect the design of the vehicle and failed to disclose or program safeguards to correct the issue of sudden acceleration.

The plaintiffs request a trial by jury and seek actual, general, special, incidental, statutory, punitive, and consequential damages; restitution; interest; order the defendant to recall and/or replace the Model X vehicles; all legal fees and any other relief as the court deems just.
