Consumer seeks rescission of sale of Ford Focus over defective transmission allegations

SAN DIEGO – An Alameda man alleges the Ford Focus he purchased has a defective transmission and seeks rescission of the sale contract.

Joel Bionso Mayala filed a complaint on Dec. 30 in the U.S. District Court for the Northern District of California against Ford Motor Co. and Does 1 through 75 citing the Song-Beverly Consumer Warranty Act and the Magnuson Moss Warranty Act.

According to the complaint, the plaintiff alleges that in December 2014, he suffered damages from purchasing a 2013 Ford Focus equipped with a defective transmission. The plaintiff holds Ford Motor Co. and Does 1 through 75 responsible because the defendants allegedly failed to fix the defects of the Dual PowerShift 6 Speed transmission and allegedly attempted to cover up the defects.

The plaintiff requests a trial by jury and seeks general damages, rescission of the purchase contract, incidental and consequential damages, equitable and injunctive relief, interest, all legal fees and any other relief as the court deems just. He is represented by Hallen D. Rosner and Jeffrey L. Le Pere of Rosner, Barry & Babbitt LLP in San Diego.
