Woman seeks reinstatement to disability benefits from Unum Life Insurance

Insurance 10

SAN FRANCISCO – A Contra Costa County woman formerly employed as an underwriting analyst alleges her disability benefits were wrongfully terminated.

Margaret Ann Van Brunt filed a complaint on Jan. 9 in the U.S. District Court for the Northern District of California against Unum Life Insurance Co. of America alleging that the insurance firm denied plaintiff's claim for disability benefits.

According to the complaint, the plaintiff alleges that she became disabled from being diagnosed with central nervous system Lyme disease in 1997 and was initially being paid disability benefits. She alleges the defendant terminated those benefits 2015. The plaintiff holds Unum Life Insurance Co. of America responsible because the defendant allegedly upheld its decision to deny further payments of disability benefits to the plaintiff despite still being disabled according to the terms of the plan.

The plaintiff seeks long-term disability benefits in the amount of $2,300.01 per month, reinstatement to the plan, all legal fees and any other relief as the court deems just. She is represented by Susan D. Pelmulder and Charles B. Perkins of Rose Perkins Pelmulder in Los Gatos.
