Waterproofing Associates Inc. claims it is owed more than $29,000 for construction work

SAN FRANCISCO – A Santa Clara County company alleges it was not paid for work on a federal project.

United States of America, for the use and benefit of Waterproofing Associates Inc., filed a complaint on Jan. 10 in the U.S. District Court for the Northern District of California against International Fidelity Insurance Co. and Does 1-10 citing the Miller Act.

According to the complaint, Waterproofing Associates Inc. provided work as a subcontractor for MENCO Pacific for the NASA Ames Research Center in 2015 and 2016 for $29,390. The suit states the defendant and MENCO had executed a payment bond. The plaintiff holds International Fidelity Insurance Co. and Does 1-10 responsible because the no amount of the $29,390 owed to Waterproofing Associates Inc. has been paid.

The plaintiff seeks for the sum of $29,390, interest at 10 percent per annum, all legal fees and any other relief as the court deems just. It is represented by Joseph M. Sweeney and Matthew J. Wendt of Sweeney, Mason, Wilson & Bosomworth in Los Gatos.
