Woman alleges Life Insurance Co. of North America wrongfully terminated benefits

SAN FRANCISCO – A Monterey County resident claims her disability benefits were wrongfully terminated.

Carol J. Cordova filed a complaint on Jan. 11 in the U.S. District Court for the Northern District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2009, she became disabled and was initially being paid disability benefits until the benefits were terminated in August 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny further payments of plaintiff's disability benefits despite her claims that she is still disabled according to the terms of the policy.

The plaintiff seeks long-term disability benefits at $26,000 at the rate of approximately $1,536 per month plus interest, all legal fees and any other relief as the court deems just. She is represented by Scott E. Shaffman of Scott E. Shaffman, S.B. in Monterey.
