Man alleges Community Legal Advisors mailed a letter that violated debt collection laws

SAN DIEGO – A Chula Vista consumer alleges an Oceanside debt collector used misleading and deceptive collection practices in a letter it sent him.

David Katz filed a complaint on Dec. 14 in the U.S. District Court for the Southern District of California against Community Legal Advisors Inc. alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that before May 3, 2016, he had incurred certain financial obligations for homeowner dues and the debt was assigned to the defendant for collection. The suit states the defendant immediately sent a dunning letter to plaintiff in its attempt to collect an alleged debt, however, its initial communication purportedly did not comply with the requirements of FDCPA and caused damages to plaintiff.

The plaintiff holds Community Legal Advisors Inc. responsible because the defendant allegedly failed to provide certain information about the alleged debt on its initial communication, and threatened plaintiff with a lawsuit and required him to explain non-payment of dues.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages, costs of litigation and attorneys' fees. He is represented by Jessica R. K. Dorman and Robert L. Hyde of Hyde & Swigart in San Diego.
