SACRAMENTO – Two individuals allege a debt collector keeps contacting them in an attempt to reach another person.
James Finley and Kiki Ball filed a complaint on Dec. 20 in the U.S. District Court for the Eastern District of California against IC Systems Inc. and Doe individuals citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiffs allege that in 2016, James Finley and Kiki Ball received several calls from the defendants in their attempt to communicate with a third party, an individual unknown to plaintiffs. More so, the calls allegedly were made using an automatic telephone dialing system or an artificial or pre-recorded voice without prior express consent, which allegedly caused plaintiffs to suffer paying for incoming call charges, and invasion of their privacy and additional risks to their public safety.
The plaintiffs request a trial by jury and seek judgment against defendants, statutory damages, injunctive relief, attorneys’ fees, costs and all other relief that the court deems just. They are represented by John P. Kristensen and David L. Weisberg of Kristensen Weisberg LLP in Los Angeles.
