LOS ANGELES – A Chatsworth costume company alleges another company copied its patterns from its catalog.
Underwraps Costume Corp. filed a complaint on Jan. 13 in the U.S. District Court for the Central District of California against Pizazz LLC, a division of the Diamond Collection LLC, and Does 1 through 10 alleging copyright infringement and other counts.
According to the complaint, the plaintiff alleges that it suffered damages to it business. The plaintiff holds Pizazz LLC, a division of the Diamond Collection LLC, and Does 1 through 10 responsible because the defendants allegedly copied poses of models, patterns and accessories worn that were depicted in plaintiff's catalog and used them in their catalog.
The plaintiff requests a trial by jury and seeks to enjoin the defendants, restitution, impound all of the defendant's costumes, pay the plaintiff for all profits and damages, all legal fees plus interest and any other relief as the court deems just.
