Tech 21 UK claims Rubicon Ventures unlawfully used patented cellphone case designs

SAN FRANCISCO – Two United Kingdom companies with an office in San Jose claim a Massachusetts company has copied its cellphone case designs.

Tech 21 UK Limited and Tech 21 Licensing Limited filed a complaint on Dec. 14 in the U.S. District Court for the Northern District of California against Rubicon Ventures LLC alleging trade dress infringement and other counts.

According to the complaint, the plaintiffs allege that they suffered damages to their business. The plaintiffs holds Rubicon Ventures LLC, responsible because the defendant allegedly infringed its patented case designs and continued to sell the products after informing the plaintiff it had stopped selling the products.

The plaintiffs request a trial by jury and seek injunctive relief, enjoin the defendant, actual damages, punitive damages, maximum damages plus profit, treble damages, interest, all legal fees and any other relief as the court deems just. They are represented by Vijay K. Toke of Cobalt LLP in Berkeley.
