Erickson Productions alleges Navistar, IC Bus continued to use photos after license expiration

LOS ANGELES – A Petaluma photography studio alleges three of its photographs were used after the license for them expired.

Erickson Productions Inc. filed a complaint on Dec. 19 in the U.S. District Court for the Northern District of California against Navistar Inc. and IC Bus LLC alleging copyright infringement.

According to the complaint, the plaintiff alleges that it and the defendants entered into a contract for the use of the three of the plaintiff's copyrighted photographs. The suit states the license on these photographs expired in March 2014. The plaintiff holds Navistar Inc. and IC Bus LLC responsible because the defendants allegedly continued to use, publish and display plaintiff's images even after the license for those images had already expired.

The plaintiff requests a trial by jury and seeks permanent injunction against the defendants, damages, interest, all legal fees, statutory damages, actual damages, profits, punitive and/ or exemplary damages, and any other relief as the court deems just.
