School Loop alleges Dewsly Education is unlawfully using mark

SAN JOSE – A San Francisco business that caters to the educational field alleges a Missouri company is using its trademark for similar services.

School Loop Inc. filed a complaint on Jan. 4 in the U.S. District Court for the Northern District of California, San Jose Division against Dewsly Education LLC, doing business as Loop, alleging trademark infringement.

According to the complaint, the plaintiff alleges it owns the trademark School Loop for its interactive platform, electronic publications and website hosting for schools. It alleges that in 2014, that the defendant began using the unregistered Loop name to offer products and services that are similar to those of plaintiff.

The plaintiff holds Dewsly Education LLC responsible because the defendant allegedly caused confusion among consumers by offering similar products and services, and using the same marks as plaintiff's distinctive marks.

The plaintiff requests a trial by jury and seeks judgment in its favor, actual, statutory, compensatory and punitive damages; interest; injunctive relief; attorneys' fees; costs of suit; and further relief as the court may deem just.
