Couture Textile accuses Ross Stores, Jainson's International of copyright infringement

LOS ANGELES – A fabric print designer alleges two companies unlawfully copied a design and used it in garments without authorization.

 

Couture Textile Inc. filed a complaint on Jan. 18 in the U.S. District Court for the Central District of California against the Ross Stores Inc., Jainson's International Inc. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its fabric design MA130947 copied. The plaintiff holds Ross Stores Inc., Jainson's International Inc. and Does 1 through 10 responsible because the defendants allegedly kept on using plaintiff's design on their fabrics despite plaintiff's request to stop using the design in 2015.

The plaintiff requests a trial by jury and seeks to enjoin the defendants from further infringing plaintiff's designs, award all profits and damages to the plaintiff, all legal fees and any other relief as this court deems just.
