Woman alleges Life Insurance Co. of North America wrongfully terminated disability benefits

LOS ANGELES – A former Carrington Mortgage Holdings employee alleges she is still disabled and that her disability benefits were wrongfully terminated.

Margaret Ploof filed a complaint on Jan. 19 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2014, she became disabled and was initially approved for disability benefits until her claim was denied on February 2016 by the defendant. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied further payment to the plaintiff based on their claim that she is no longer disabled.

The plaintiff seeks benefits not paid to the plaintiff plus interest, declare that the plaintiff is entitled to future disability benefits, all legal fees and any other relief as the court deems just. She is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Philip S. Bather of Darras Law in Ontario.
