Shephard Mechanical Contractors Inc. alleges it is owed thousands from contractor

SACRAMENTO – A Sacramento County subcontractor alleges it is owed more than $300,000 for work on a federal project.

The United States of America and Shephard Mechanical Contractors Inc. filed a complaint on Jan. 17 in the U.S. District Court for the Eastern District of California against K.O.O. Construction Inc. and Travelers Casualty and Surety Co. of America citing the Miller Act.

According to the complaint, on Sept. 27, 2012, the United States of America entered into a prime contract with K.O.O. to perform construction work at the Marine Corps Mountain Warfare Training Center in Bridgeport. The suit states K.O.O. subcontracted Shephard to furnish labor, services, materials and equipment relating to the heating, ventilation and air conditioning system in total amount of $1,937,129.77. The suit states K.O.O. has paid Shephard $1,593,932.13 and a balance of $343,197.64 remains due and owing.

The plaintiffs seek judgment, on behalf and for the benefit of Shephard, for the principal sum of $343,197.64, penalties, interest, attorney's fees, costs of suit and further relief as the court deems just. They are represented by Brian D. Bertossa and Stephen R. McCutcheon Jr. of Cook Brown LLP in Sacramento.
