TCEC, Papaya accused of copying Forever 21 design

LOS ANGELES – Forever 21 alleges one of its exclusive designs was copied without authorization.

Forever 21 Inc. filed a complaint on Jan. 23 in the U.S. District Court for the Central District of California, Western Division against C Luce Inc. doing business as TCEC; Cornerstone Apparel Inc., doing business as Papaya; and Does 1 through 10 citing copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its designs copied. The plaintiff holds C Luce Inc. doing business as TCEC; Cornerstone Apparel Inc., doing business as Papaya; and Does 1 through 10 responsible because the defendants allegedly continued to copy plaintiff's design and did not obtain consent or authorization from the plaintiff for the use of the design.

The plaintiff requests a trial by jury and seeks award of profits and damages, statutory damages, injunction against the defendant, restitution, order the destruction of infringing materials, exemplary or punitive damages, all legal fees and any other relief as the court deems just.
