Time Warner Cable employee files suit over amount of pension payment

RIVERSIDE – A Riverside County man has filed suit against his former employer over an alleged discrepancy in his pension.

Thomas Sperduto filed a complaint on Jan. 24 in the U.S. District Court for the Central District of California against the Time Warner Cable Inc., doing business as Spectrum, and Does 1 through 20 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2009, he was told by a representative of the defendant that he would receive a pension of $2,248.16 when he turned 65. He alleges that he confirmed this payment in September 2014, but was then advised the amount would be $792.42. The plaintiff claims that he filed a claim in June 2015 for additional pension benefits and questioned the amounts, but the claim was denied in September 2015, as has an appeal.

The plaintiff requests a trial by jury and seeks declare plaintiff's rights to monthly pension benefits in the amount of $2,248.16, all legal fees, interest, surcharge, restitution, and any other relief as the court deems just.
