LOS ANGELES – A Los Angeles company claims two of its original two-dimensional artworks were used in clothing without its permission.
Universal Dyeing & Printing Inc. filed a complaint on Feb. 1 in the U.S. District Court for the Central District of California against MIO Wholesale, Wholesale Fashion Square and Does 1 through 10 copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having its 15554 and 16128 designs used on other fabrics. The plaintiff holds MIO Wholesale, Wholesale Fashion Square and Does 1 through 10 responsible because the defendants allegedly sold garments featuring plaintiff's fabric designs without authorization.
The plaintiff requests a trial by jury and seeks enjoin the defendants, all profits, statutory damages, all legal fees plus interest and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, and Frank Gregory Casella of Doniger/Burroughs in Venice.
