Woman alleges Samsung washer is defective, has not been repaired

LOS ANGELES – A Murrieta consumer has filed a class action suit over the options available to her to replace an allegedly defective washing machine.

Michelle Madrid filed a complaint on behalf of all others similarly situated on Feb. 3 in the U.S. District Court for the Central District of California against Samsung Electronics America Inc., Samsung Electronics Co. LTD, The Home Depot Inc., Lowe's Cos. Inc., Best Buy Co. Inc., and Sears Holding Corp. alleging breach of implied warranty, negligence, unjust enrichment and other counts.

According to the complaint, the plaintiff alleges that she purchased a defective Samsung washing machine from Best Buy in 2016 that she can no longer use due to the recall order because of the danger that it could explode during normal use. The plaintiff holds the defendants responsible because the defendants allegedly failed to repair, fix the defects found on the washing machine or provide acceptable alternatives of compensation to consumers that have already purchased the product.

The plaintiff requests a trial by jury and seeks damages, enjoin the defendants, restitution, replacement of all defective parts, punitive damages, all legal fees plus interest and any other relief as the court deems just. She is represented by James R. Noblin of Green & Noblin P.C. in Long Beach.
