Spearmint Rhino dancer claims she was not paid a minimum wage, files class action

RIVERSIDE – A dancer at an adult entertainment club alleges she and others were misclassified as independent contractors and has filed a class-action suit.

Adriana Ortega filed a complaint on behalf of all others similarly situated on Feb. 3 in the U.S. District Court for the Central District of California, Eastern Division against The Spearmint Rhino Cos. Worldwide Inc., Spearmint Rhino Consulting Worldwide Inc., and Midnight Sun Enterprises LLC citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked as a dancer without being paid a minimum wage. The plaintiff holds Spearmint Rhino Cos. Worldwide Inc., Spearmint Rhino Consulting Worldwide Inc., and Midnight Sun Enterprises LLC responsible because the defendants also allegedly failed to provide itemized wage statements to the plaintiff or reimburse her for work-related expenditures.

The plaintiff seeks all damages, liquidated damages, statutory penalties, all legal fees plus interest and any other relief as the court deems just. She is represented by Shannon Liss-Riordan of Lichten & Liss-Riordan PC in Boston.
