SAN DIEGO – A San Diego County woman claims she was terminated because of her age.

Kathy Sue Lange filed a complaint on Jan. 30 in the U.S. District Court for the Southern District of California against the Regents of the University of California and Does 1-10 citing the Employee Retirement Income Security Act and age discrimination.

According to the complaint, the plaintiff alleges that on Feb. 5, 2016, the defendants terminated her employment after serving 9.8 years with them. She alleges she was four months short to acquiring additional and substantial retirement and health care benefits and believes her termination was motivated by defendants' refusal to pay for additional benefits.

The plaintiff holds the Regents of the University of California and Does 1-10 responsible because the defendants allegedly terminated plaintiff on pre-textual reasons, and discriminated against plaintiff's age as basis for her termination or to re-hire her for other job positions.

The plaintiff requests a trial by jury and seeks judgment against defendant; compensatory, special and restitution damages; costs of suit; attorneys’ fees; interest; reinstate plaintiff to prior or similar position; injunction prohibiting further acts of discrimination and retaliation; and further relief as the court may deem just. She is represented by William B. Sullivan, Eric K. Yaeckel and Clint S. Engelson of Sullivan Law Group in San Diego.
