Retirement plan alleges Fox Printing owes more than $3 million after withdrawing from plan

LOS ANGELES – A Sun Valley employer is alleged to have not paid an assessment after withdrawing from participating in a labor union plan.

GCIU-Employer Retirement Fund and board of trustees of the GCIU-Employer Retirement Fund filed a complaint on Feb. 8 in the U.S. District Court for the Central District of California, Western Division against Fox Printing Co. Inc. and Gary Fox citing the Employee Retirement Income Security Act.

According to the complaint, the defendant withdrew from participating in the plaintiffs' funds. The plaintiff holds Fox Printing Co. Inc. and Fox responsible because the defendants allegedly did not pay the withdrawal liability assessment.

The plaintiff seeks past due liability payment of $3,527,749, interest, all legal fees and any other relief as the court deems just. They are represented by Kerry K. Fennelly and Valentina S. Mindirgasova of Cornwell & Baldwin in Escondido.
