LOS ANGELES — An individual has filed a class-action lawsuit regarding a pension plan.
John Baleja filed a complaint on behalf of all others similarly situated on Feb. 8 in the U.S. District Court for the Central District of California, Eastern Division against Salaried Pension Plan, Northrop Grumman Benefit Plans Administrative Committee, Northrop Grumman Corp., and Does 1 through 10 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that he was previously enrolled in the ESL Retirement Fund, which was terminated in 1984 and replaced by the TRW plan. In December 2015, the suit states he contacted the Northrop Grumman Benefits Center inquire about his pension benefits and was quote that he would receive $1,066.80 per month. The suit states a later letter dated in January that reduced this amount by $471.30 per month.
The plaintiff holds Northrop Grumman Space & Mission Systems Corp. Salaried Pension Plan, Northrop Grumman Benefit Plans Administrative Committee, Northrop Grumman Corporation, and Does 1 through 10 responsible because the defendants allegedly failed to inform the plaintiff regarding the ESL offset and use terms that are easily understood.
The plaintiff seeks benefits due, order the plan to remove the terms that constitute the ESL offset, surcharging defendants for their breaches of duty, all legal fees interest and any other relief as the court deems just. He is represented by Victor O'Connell, Peter K. Stris, Brendan S. Maher and Shaun P. Martin of Stris & Maher LLP in Los Angeles and San Diego.
