LOS ANGELES – A Dallas company that sells home goods alleges its marks are unlawfully being used by a Los Angeles corporation.
Branded LLC filed a complaint on Feb. 13 in the U.S. District Court for the Central District of California against Clique Media Inc. alleging trademark infringement, false designation of origin and other counts.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having its trademark Domain copied and used on similar products. The plaintiff holds Clique Media Inc. responsible because the defendant allegedly used the Domaine and MyDomaine marks on its products, which the plaintiff alleges is likely to cause confusion among consumers.
The plaintiff requests a trial by jury and seeks enjoin the defendant, order the destruction of all infringing materials, all damages, profits, enhanced damages, treble damages, all legal fees, interest and any other relief as the court deems just.
