Green Fitness Equipment Co. claims Precor Inc. infringed Treadmill Saver

SAN DIEGO – A Del Mar health and fitness company claims its device was unlawfully duplicated.

Green Fitness Equipment Co. LLC filed a complaint on Feb. 8 in the U.S. District Court for the Southern District of California against Precor Inc., 24 Hour Fitness USA Inc. and Does 1-10 alleging patent infringement and other counts.

According to the complaint, the plaintiff alleges that Precor Inc. tried to reverse-engineer plaintiff's Treadmill Saver gadget to duplicate plaintiff's technology and incorporate the system in its new line of treadmills. The suit states that consequently, 24 Hour Fitness was influenced by Precor to purchase its new treadmill instead of plaintiff's product.

The plaintiff holds Precor Inc., 24 Hour Fitness USA Inc. and Does 1-10 responsible because Precor Inc. allegedly adapted the system invented by plaintiff without authorization.

The plaintiff requests a trial by jury and seeks judgment in its favor, permanent injunction, lost profits, treble and/or enhanced damages, attorneys’ fees, interest, costs of action, declaratory relief, actual damages, and further relief as the court deems just.
