SAN DIEGO – A San Diego corporation is alleged to have unlawfully used a wildlife photo on its website without permission.
Masterfile Corp. filed a complaint on Feb. 8 in the U.S. District Court for the Southern District of California against the Wejungo Corp. and Susan S. Japs alleging copyright infringement.
According to the complaint, the plaintiff alleges that the defendants had reproduced, displayed and distributed plaintiff's registered image titled "Zebra and Wildebeest Etosha National Park Namibia, Africa" on their website without license or authority from plaintiff. The plaintiff holds Wejungo Corp. and Japs responsible because the defendants allegedly obtained profits that rightfully belong to the plaintiff.
The plaintiff requests a trial by jury and seeks judgment against defendants, account gains and profits from infringement, statutory damages in the amount of $150,000, costs of litigation, attorneys’ fees, interest, and further relief as the court deems just.
