Daelim Industrial Co. claims ECC International did not pay for work on federal project

SAN FRANCISCO – A Burlingame construction contractor is accused of not paying a subcontractor for work on a federal project.

United States of America, on behalf of Daelim Industrial Co. LTD, filed a complaint on Feb. 16 in the U.S. District Court for the Northern District of California against ECC International LLC, Liberty Mutual Insurance Co. and Does 1 to 20 alleging breach of contract.

According to the complaint, on Nov. 8, 2013, the U.S. entered into a written agreement with defendant ECCI for construction services for an information facility in Korea. The suit states that ECCI entered into an agreement with Daelim in 2013 for construction services for the project. Daelim alleges that ECCI failed to pay for its invoices. The unpaid amount is approximately $3.9 million, the suit states.

The plaintiffs hold ECC International LLC, Liberty Mutual Insurance Co. and Does 1 to 20 responsible because despite demands for payment, defendant ECCI allegedly has refused and continues to refuse to submit payments to Daelim's materials and services provided to defendant ECCI.

The plaintiff requests a trial by jury and seeks judgment against defendants and each of them for special damages, prejudgment interest, attorney’s fees, costs of suit and such other and further relief as the court deems proper. They are represented by Daniel F. McLennon and Craig Wallace of Smith, Currie & Hancock LLP in San Francisco.
