Hillenbrand Excavation Inc. accused of not paying contributions

SAN FRANCISCO – Several labor union funds allege a California corporation has failed to pay employee contributions.

Operating Engineers' Health and Welfare Trust Fund for Northern California, et al. filed a complaint on Feb. 22 in the U.S. District Court for the Northern District of California against Hillenbrand Excavation Inc. and David Edward Hillenbrand citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late benefit contributions. The plaintiffs hold Hillenbrand Excavation Inc. and Hillenbrand responsible because the defendants allegedly have failed an refused to comply with a payroll audit and have failed to report and pay contributions for periods in 2016.

The plaintiffs seek to enjoin the defendants, all unpaid contributions, liquidated damages, interest, all legal fees and any other relief as the court deems just. They are represented by Michele R. Stafford and Edward D. Winchester of Saltzman & Johnson Law Corp. in San Francisco.
