JS Taylor Construction Inc. alleged to owe unpaid contributions

Contract 07

SAN FRANCISCO An employer is alleged to have not paid contributions to several labor union funds.

Operating Engineers' Health and Welfare Trust Fund for Northern California, et al. filed a complaint on Feb. 22 in the U.S. District Court for the Northern District of California against JS Taylor Construction Inc., formerly doing business as JW Taylor Construction; and Joshua Thiel, citing the Employee Retirement Income Security Act and the Labor Management Relations Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions from periods in 2014, 2015, 2016 and 2017. The plaintiffs hold JS Taylor Construction Inc., formerly doing business as JW Taylor Construction; and Thiel responsible because the defendants allegedly breached their bargaining agreement when they failed to pay monthly benefit contribution on behalf of their employees.

The plaintiffs seek all unpaid contributions, liquidated damages, interest, all legal fees and any other relief as the court deems just. They are represented by Michele R. Stafford and Edward D. Winchester of Saltsman & Johnson Law Corp. in San Francisco.
