SAN FRANCISCO – A Walnut Creek consumer claims a debt collector did not mark an alleged debt as disputed.
Sergio Castillo filed a complaint on Feb. 23 in the U.S. District Court for the Northern District of California against Convergent Outsourcing Inc. alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that he suffered damages to his credit history because of the defendant's misleading and unfair debt collection practices. The plaintiff holds Convergent Outsourcing Inc. responsible because the defendant allegedly re-reported an alleged debt the plaintiff had disputed on his credit report without listing it as disputed by the consumer.
The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. He is represented by Jonathan A. Stieglitz of The Law Offices of Jonathan A. Stieglitz in Los Angeles.
