Nurse alleges Hartford Life and Accident Insurance Co. wrongfully terminated benefits

SACRAMENTO – A clinical nurse alleges her disability benefits were wrongfully terminated.

Patricia Gibson filed a complaint on Feb. 9 in the U.S. District Court for the Eastern District of California against Hartford Life and Accident Insurance Co. and Group Long Term Disability and Life Plan for employees of Community Medical Centers alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2014, her claim for long-term disability benefits was approved but was later denied. The plaintiff holds Hartford Life and Accident Insurance Co. and Group Long Term Disability and Life Plan for employees of Community Medical Centers responsible because the defendants allegedly upheld their decision to deny plaintiff's disability benefits despite her being disabled according to the terms of the plan.

The plaintiff seeks award benefits to the plaintiff plus interest, all legal fees and any other relief as the court deems just. She is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of DarrasLaw in Ontario.
